Mock Negotiation and ABCs of a Music Producer Deal
Wed May 15, 2019 in Atlanta
NARIP Mock Negotiations Generate Better Deals!
A NARIP Series: Mock Negotiations Clarify Most Important, Career-Supporting (or detracting) Deal Points for Laymen
Are you making good deals for yourself and for your clients? Is a bad deal holding you back?
At NARIP’s Art of the Music Deal series featuring mock negotiations of the most important music business deals, you get to meet top industry deal-makers including music and entertainment attorneys, label and music publishing executives, personal artist and producer managers, and producers to hear their in-depth discussion, debate and dissection of key music business deals. No more fear of the fine print! Our experts break it down in easy-to-understand language, with sample agreements and checklists to support your next negotiation.
Top executives wrangle a career-making music producer deal at NARIP’s May 15h program in Atlanta. Most people think they can just hand a negotiation to a lawyer, and leave it at that. But as a professional, you need to understand the process and deal points, too, and what the short- and long-term implications to your artists’ careers may be. In this session, top experts producer-manager Rico Brooks, music and entertainment attorney David Prasse, Esq. and producer-label owner Tanner Hendon discuss key areas of a music producer agreement and negotiate a deal LIVE.
They will give you the inside track on major deal points, what they mean and what leverage you have to negotiate the best possible deal. Most importantly, you will see HOW a producer deal is negotiated and see the process. Get educated about the art of deal making and the right time to make a deal!
BACKGROUND
Since 2008, NARIP’s Art of the Music Deal series has presented, broken down and explained dozens of important deals in layman’s terms, including:
- 360 record deals
- distribution
- music publishing
- sponsorship & merchandise
- personal artist management deals
- music producer deals
- and more
As a consequence, hundreds of NARIP members and their clients have made better deals. Producer Manager RicoBrooks – who will speak at NARIP’s program on May 15, 2019 in Atlanta – learned key deal points that he implemented IMMEDIATELY in his business after attending NARIP’s 2017 Mock Negotiation of a Music Producer Deal featuring speakers Evita G. Kaigler, Esq., Kendall A. Minter, Esq. and Julie Kessler Roach, Esq.
That’s valuable!
Topics at NARIP’s Mock Negotiation & ABCs of a Music Producer Deal:
- Logistics: Where song is recorded, artist approvals, producer deliverables.
- Master Recording: Who will own and control it? What does this include? Exclusive rights to manufacture, distribute and issue master use licenses.
- Splits: Is producer also a songwriter? What percentage, if any, is producer entitled to of the song’s copyright?
- Fees: How, what and when will producer be paid? Up-front and back-end compensation.
- Credit: What specific credit will producer receive?
- General Clauses, Terms & Options: Original work, indemnification and more.
Also to be discussed:
- Producer advance vs. recording fund. Did you know it all comes out of the artist’s recording fund? Producer royalty. Did you know it all comes out of the artist’s royalty?
- Recoupment
- Controlled Composition Clause: what you need to know if your producer is also your co-writer. What does the artist’s recording agreement say? This affects the producer’s royalty, royalty accountings, mechanical royalties, CD reductions, “fake” free goods and much more.
- Assignment
- Learn what to ask for and what to avoid in your next deal, walk away from NARIP’s program armed with important checklists and a sample form agreement of a music producer deal
- Direct access + firsthand info = better results FOR YOU
BONUS: Sample music producer form agreement will be provided.
NARIP programs enable a deep dive into important deals and enable audience questions and direct feedback, making them even more valuable.
Most important, attendees meet these key players, paving the way for deals, representation, collaboration and ongoing opportunities, and giving them an edge in a competitive market.
Be prepared to take plenty of notes!

SOLD OUT: NARIP Preditor Pitch Session (Blacklist, World of Dance, Chicago Fire, Amercia’s Got Talent): NBC Entertainment Marketing’s Chad Mallam
×
NARIP “Preditor” (Producer / Writer / Editor) Pitch Session
with NBC Entertainment Marketing’s Chad Mallam

Tue May 7 in Los Angeles – this event is SOLD OUT
Harness the Power of a “Preditor” (Producer / Writer / Editor) to Exploit and Monetize Your Music!
A NARIP Series: Intimate Pitch Meetings with Top Music Buyers including Music Supervisors, Synch Agents, Music Producers, Music Editors and “Preditors” (Producer / Writer / Editors)
Is your music getting to decision-makers – people who can say YES and write a check?
At NARIP’s intimate sessions, you get to meet music buyers including music supervisors, synch agents, music producers, music editors and “Preditors” (Producer / Writer / Editors), and pitch for current placement opportunities, representation and projects, and get immediate feedback.
BACKGROUND
Since 2011, NARIP Music Supervisor Pitch Sessions have secured over 1,000 placements in blockbuster films, hit television series, global promotion and advertising campaigns, and major studio trailers for NARIP members. Since inception of NARIP’s Synch Agent Pitch Sessions in 2018, 15 NARIP members have signed representation or music publishing deals as a direct result. Other outcomes include collaborations, co-writing, producing and commissioned work.
Topics at NARIP’s “Preditor” (Producer / Writer / Editor) Pitch Session:
- Access top, award-winning NBC Entertainment Marketing executive who seeks NEW SOURCES for music
- Pitch for current & upcoming slate of DOZENS of prime-time network shows, specials and up-fronts. Shows include America’s Got Talent, Chicago Fire, Chicago Med, Chicago PD, Black List, World of Dance, Ellen’s Game of Games and others.
- Present songs to top television executive who helps source and place music for THOUSANDS of promos PER WEEK across the entire network
- Pitch directly to top executive who knows what works and gets what he wants (no middleman)
- Trends in promotional music: what works, what doesn’t and WHY
- Budgets and fee ranges
WHY DO NARIP PITCH SESSIONS CONTINUE TO YIELD SUCH REMARKABLE RESULTS?
- Small, focused NARIP Sessions enable one-on-one time and immediate direct feedback to music presented by participants.
- NARIP Pitch Sessions are limited to 16 people: get to know the guest buyer who gets to know YOU.
- Attendees meet key players, paving the way for placement, representation, collaboration and ongoing opportunities, and giving them an edge in a competitive market.
- 100% practical, no fluff, non-nonsense approach makes NARIP Pitch Sessions “highly effective”
- No blind pitches – get guest buyer’s brief of then-current music needs ONE WEEK PRIOR to event date, giving you time to prep best possible pitch.
WHAT TO EXPECT AT A NARIP PITCH SESSION:
PREPARATION IS KEY
NARIP Pitch Sessions are limited to an enrollment of just 16 people. About one week prior to NARIP’s Session, all registrants will get a brief of the guest’s then-CURRENT music needs. Each registrant will have a chance to pitch in response to the music briefs provided and get immediate feedback to music pitched. Each participant must submit 6 songs (MP3s only please) 36 hours prior to NARIP’s Pitch Session. Please note that due to time constraints you will only be able to pitch your TOP 3 songs for consideration and immediate feedback (more songs, if time permits). This process takes the mystery out of why a piece of music does or doesn’t fit. On-the-spot feedback enables registrants to re-work tracks and re-submit, which creates a much higher probability to get them picked up or licensed (choose well!).
If you do not have music that matches the current needs of the guest, fear not! You can still attend and present the top three songs in your catalog. Make sure the songs are unique and captivating. This is helpful because a music buyer’s needs change constantly and you want your music to make an impression. To optimize impact of music you pitch at NARIP’s Session, we highly recommend that you target the briefs which you will get one week prior to the Session.
In addition to pitching for current opportunities, NARIP’s guest producer will consider music pitched for collaboration, signing to his label Hundred Up (in the case of Harvey Mason, Jr.), producing and co-producing.
Good luck and see you there!
BEFORE NARIP’S PITCH SESSION:
- NARIP prepares a one-sheet for each participant including your photo and bio for the guest to use and review at the event, and to take with him after the event. We will request your photo and bio one week prior to the event. In preparing these materials, we recommend you focus on brief career highlights in your bio and have a professional photo available.
- Approximately 5 to 7 days prior to NARIP’s Session, you will be sent a project brief describing several cues needed for a current project(s) of our guest speaker. These often include reference songs or links so that you can hear exactly what he seeks or needs to replace.
- You will submit your tracks with writer, publisher and other rights holder information that will also be supplied to the music supervisor during and after NARIP’s Session.
- You will get submission and meta-tagging guidelines, and mentoring as to how best to prepare your music for submission.
DURING NARIP’S PITCH SESSION:
- You will get to play at least three songs (sometimes more, if time permits) for the guest who will provide feedback to you for each one.
- NARIP moderator asks very specific questions to help participants learn and understand how to modify their tracks to make these more place-able for the guest’s specific needs at hand.
AFTER NARIP’S PITCH SESSION:
- NARIP provides guest music supervisor with participant one-sheets and all music from NARIP’s Session, including notes detailing the guest’s interest in specific tracks.
- If requested by guest, NARIP conveys additional tracks, remixes, instrumentals etc. to him.
- If approved by guest, NARIP provides his contact details to registrants.
DON’T GET LOST IN THE CROWD: SMALL IS THE NEW BIG
NARIP Sessions are deliberately kept small and intimate, which is just one reason they work so well and why participants have enjoyed over 1,000 placements to date. Limited enrollment of 16 people per session guarantees that registrants meet and get face-time with our guest.
OVER 1,000 PLACEMENTS and 14 DEALS FROM NARIP MUSIC SUPERVISOR SESSIONS
Our small format works! NARIP Session participants have placed over 1,000 tracks as a direct result of NARIP Music Supervisor Sessions. Other benefits include new publishing deals for NARIP members, creative collaborations and co-writes, strategic introductions to other music supervisors and placement experts, new representation for composers and much more.

Click here to read about NARIP’s biggest placement to date in a Vodafone campaign (Oct 2014) that paid handsomely and launched a career. Other brand placements include McDonalds and AT&T ads, among others.

- Which synch agents seek a transfer of copyright(s) for their services, and under what circumstances
Small, focused NARIP Sessions enable one-on-one time and immediate direct feedback to music presented by participants. At hundreds of NARIP Sessions, we asked every guest music supervisor how to better market music to them. Their one consistent piece of advice? Get representation!
At NARIP Synch Agent Pitch Sessions, limited to 16 people, you get to know the synch agents and they to get to know you.
Most important, attendees meet these key players, paving the way for possible representation and ongoing opportunities, and giving them an edge in a competitive market.
* Synch Agent: A synchronization or “synch” agent represents music copyrights – either the composition, the sound recordings, or both. They pitch music to buyers and their representatives, including to music supervisors. Synch agents are typically compensated on a commission basis and do not own or control the copyrights they represent. While synch agents usually focus on entertainment and media exploitations, traditional songplugger services also include placement of represented songs with recording artists.

A NARIP Series: Intimate Pitch Meetings with Top Music Buyers including Music Supervisors, Synch Agents & Music Producers
Is your music getting to decision-makers – people who can say YES and write a check?
At NARIP’s intimate sessions, you get to meet music buyers including music supervisors, synch agents and music producers and pitch for current placement opportunities, representation, and projects, and get immediate feedback.
Topics at NARIP’s Producer Pitch Sessions:
- Access Oscar-nominated, Grammy-winning hitmaker, pitch for his current & future projects
- Present songs to Harvey, who currently seeks hip hop, pop and R&B
- Meet Harvey who can say YES and write you a check.
- How to get cuts on developing artist and super star albums
- Budgets, fee ranges and deal points between producers and their clients
- Audition for Harvey’s label Hundred Up and Producer-Writer team
- Direct access + firsthand info = better results FOR YOU
Small, focused NARIP Sessions enable one-on-one time and immediate direct feedback to music presented by participants.
At NARIP Pitch Sessions, limited to 16 people, you get to know the guest music supervisor, synch agent or producer, and they to get to know you.
Most important, attendees meet these key players, paving the way for placement, representation, collaboration and ongoing opportunities, and giving them an edge in a competitive market.
WHAT TO EXPECT AT A NARIP PITCH SESSION: PREPARATION IS KEY
OVER 1,000 PLACEMENTS and 15 DEALS FROM NARIP MUSIC SUPERVISOR SESSIONS
Our small format works! NARIP Session participants have placed over 1,000 tracks as a direct result of NARIP Music Supervisor Sessions. Other benefits include new publishing deals for NARIP members, creative collaborations and co-writes, strategic introductions to other music supervisors and placement experts, new representation for composers and much more.

ABOUT HARVEY MASON, JR.
Harvey Mason Jr. has not only penned and produced songs for industry legends like Aretha Franklin, Michael Jackson, Luther Vandross and Elton John, but also for today’s superstars including Justin Bieber, Britney Spears, Justin Timberlake and Chris Brown. Simultaneously, Harvey has been instrumental in producing memorable music for many of the biggest musical films from the past decade. Everyone from Beyoncé and Jennifer Hudson in Dreamgirls, Whitney Houston in Sparkle, to the eclectic casts in Pitch Perfect and SING, Dr. Dre and Ice Cube in Straight Outta Compton and Mary J. Blige and Ne-Yo in The Wiz Live! have called on Harvey to deliver music of the highest standards for blockbuster musical productions.
Harvey was born in Boston, Massachusetts where his parents attended the prestigious Berklee College of Music. Harvey’s father, Harvey Mason, Sr., is a noted jazz drummer and founding member of the group Fourplay. Mason Jr. grew up in Los Angeles where he tagged along to his father’s recording sessions with the likes of Quincy Jones, Carole King, The Brothers Johnson and Herbie Hancock. Harvey wrote his first song, “Love Makes It Better” for Grover Washington, Jr. at the age of eight. Besides being a gifted musician, Harvey was also a skilled athlete and attended the University of Arizona on a basketball scholarship, playing in the 1988 Final Four with teammates Sean Elliott and Steve Kerr.
Harvey’s first success came when he wrote the song “Truthfully” for Brandy’s 1998 release Never Say Never. He then joined forces with Rodney Jerkins’ Darkchild Entertainment and continued to write and produce hits for the likes of Jennifer Lopez, Destiny’s Child, Toni Braxton, Whitney Houston and Michael Jackson. In 2000, Mason Jr. formed the production company, The Underdogs, whose first hit was Tyrese’s “I Like Them Girls.” He continued to top the R&B charts with hits for B2K, Marques Houston, Ruben Studdard, Joe, Ciara and Omarion, making history in 2009 with the number one hit, “No Air” featuring Jordin Sparks and Chris Brown, and again in 2012 with Chris Brown’s “Turn Up the Music.”
In 2006, Harvey produced the soundtrack for the movie musical Dreamgirls where his work on Jennifer Hudson’s rendition of “And I’m Telling You I’m Not Going” helped earn her an Academy Award for her performance. His work on Dreamgirls was the first to produce three Oscar-nominated songs from the same film in the same year. In 2008, Harvey Mason Media produced the major motion picture More Than a Game documenting the incredible journey of LeBron James’ high school basketball team. The movie garnered a second-place People’s Choice Award at the prestigious Toronto Film Festival. Harvey also composed the score to the film and served as Executive Producer on the soundtrack Music Inspired by More Than a Game, released on his label Mason Music through Interscope Records.
In 2012, Harvey was nominated for a Golden Globe Award for the song “The Living Proof” from The Help which featured Mary J. Blige. Then sadly, he was the last producer to work with Whitney Houston when he produced the songs “His Eye Is on the Sparrow” and “Celebrate” for the movie Sparkle. Later in 2012, Harvey produced the a cappella vocal performances for the hit film Pitch Perfect featuring Rebel Wilson and Anna Kendrick. In 2014, he produced the music for Get On Up, the film about the life and music of the legendary James Brown. With the addition of Hailee Steinfeld, Harvey again joined the cast of Pitch Perfect 2 to produce new a cappella hits for the movie’s 2015 sequel. In the summer of 2015, Harvey arranged and produced all the legendary N.W.A. music for the theatrical release of Straight Outta Compton. Most recently, he wrote and produced music for the top-rated NBC broadcast of The Wiz Live! and produced over 50 songs for the animated musical SING from Universal/Illumination Entertainment. Currently, Harvey is in production for Pitch Perfect 3 and the musical reworking of the 80’s classic, Valley Girl for MGM.
Harvey proudly serves as a board member and advocacy leader for The Recording Academy and its Producers and Engineers Wing. He is also a member of the Board of Trustees for his Alma mater, the University of Arizona. Harvey donates his time and resources to several charitable organizations including GRAMMY in the Schools, MusicCares Foundation, Ronald McDonald House, the American Cancer Society, and Los Angeles Children’s Hospital. Harvey received the Spirit of Excellence Award in 2012 by the T.J. Martell Foundation for his philanthropic efforts.

In Atlanta – Registering Music For Protection & Profit
×
For those who create, publish and invest in intellectual property such as songs, registration is the most important thing you can do to protect these assets. Registering ensures that public performance revenues flow unimpeded to you, and secures full benefits for song and sound recording copyrights.
Registering with the US Copyright Office for example gives the registrant important legal recourse should a dispute or infringement occur.
Also important is affiliating and registering with a performing rights society (to enable collection of performance royalties) and with the Harry Fox Agency (to enable collection of mechanical royalties).
NARIP is pleased to present expert Brei Jones (other experts TBA) who will demonstrate and walk us through these processes including how to register, affiliate and collect. She will also detail the financial advantages of various affiliations as well as alternatives to using foreign sub publishers
YOU WILL LEARN
- How to set up an account with the Library of Congress to register copyrights
- What form to use and why plus requirements (PA, PAu / SR, SRu)
- What to include on the forms
- How to affiliate as a songwriter and publisher with a U.S. performing rights organization (PRO)
- Compare requirements & costs for each society (ASCAP, BMI and SESAC)
- Why it’s important to have writer AND publisher affiliations in same place
- How to register compositions at ASCAP, BMI and SESAC
- What is a CAE / IPI, what’s it used for?

WHAT TO EXPECT AT A NARIP MUSIC SUPERVISOR PITCH SESSION
PREPARATION IS KEY
NARIP Music Supervisor Sessions are limited to an enrollment of just 16 people. About one week prior to NARIP’s Session, all registrants will get a brief of the guest supervisor’s then-CURRENT music needs. Each registrant will have a chance to pitch in response to the music briefs provided and get immediate feedback to music pitched. Each participant must submit 7 songs (MP3s only please) 36 hours prior to NARIP’s Music Supervisor Session. Please note that due to time constraints you will only be able to pitch your TOP 3 songs for consideration and immediate feedback (more, if time permits). This process takes the mystery out of why a piece of music does or doesn’t fit. On-the-spot feedback enables registrants to re-work tracks and re-submit, which creates a much higher probability to get them licensed (choose well!).
If you do not have music that matches the current needs of the supervisor, fear not! You can still attend and present the top three songs in your catalog. Make sure the songs are unique and captivating. This is helpful because a music supervisor’s needs change constantly. To optimize impact of music you pitch at NARIP’s Music Supervisor Session, we highly recommend that you target the briefs. Good luck and see you there!
BEFORE NARIP’S PITCH SESSION:
- NARIP prepares a one-sheet for each participant including your photo and bio for the guest music supervisor to use and review at the event, and to take with him after the event.

- You will get to play at least three songs (sometimes more, if time permits) for the guest music supervisor who will provide feedback to you for each one.
- NARIP moderator asks very specific questions to help participants learn and understand how to modify their tracks to make these more place-able for the guest supervisor’s specific needs at hand.
AFTER NARIP’S PITCH SESSION:
- NARIP provides guest music supervisor with participant one-sheets and all music from NARIP’s Session, including notes detailing the guest music supervisor’s interest in specific tracks.
- If requested by guest music supervisor, NARIP conveys additional tracks, remixes, instrumentals etc. to him.
- If approved by guest music supervisor, NARIP provides his contact details to registrants.

A NARIP Series: Intimate Pitch Meetings with Top Synch Agents
Is your music getting to decision-makers – people who can say YES and write a check?
The Synch Agents* featured in NARIP Pitch Sessions are among the top sales and marketing executives who actively place music owned by songwriters, composers and independent music publishers.
Many music buyers – directors, producers and music supervisors – name these Synch Agents as among their go-to music providers. These Agents, who NARIP has researched and interviewed, have placed thousands of songs in blockbuster films, hit television shows, trailers, global promotion and advertising campaigns, and video games.
At NARIP’s intimate sessions, you get to meet and pitch Synch Agents for current placement opportunities and representation, and get immediate feedback.
Come meet these career-makers.
BACKGROUND
Since 2011, NARIP Music Supervisor Pitch Sessions have secured over 1,000 placements in blockbuster films, hit television series, global promotion and advertising campaigns, and trailers for NARIP members.
NARIP members have also secured publishing deals and formed creative collaborations too numerous to mention as a direct result of these NARIP’s Sessions.
Topics
- Access multiple potential buyers and placements
- Trends in synch licensing and agent deals
- Exclusive, non-exclusive, single-song deals
- Budgets and fee ranges
- Royalties, copyright ownership, rights retention
- Fees and deal points between synch agents and their clients
- Which synch agents seek a transfer of copyright(s) for their services, and under what circumstances
- Song re-titling
What is a Synch Agent (and WHY you need one)? View video (:60 seconds)
WHAT TO EXPECT AT A NARIP SYNCH AGENT PITCH SESSION:
PREPARATION IS KEY
As with NARIP Music Supervisor Pitch Sessions, NARIP’s Synch Agent Pitch Sessions are limited to an enrollment of just 16 people. About one week prior to NARIP’s Session, all registrants will get a brief of the guest’s then-CURRENT music needs. Each registrant will have a chance to pitch in response to the music briefs provided and get immediate feedback to music pitched. Each participant must submit 7 songs (MP3s only please) 36 hours prior to NARIP’s Synch Agent Pitch Session.
If you do not have music that matches the current needs of the guest, fear not! You can still attend and present the top three songs in your catalog. Make sure the songs are unique and captivating. This is helpful because a music supervisor’s needs change constantly. To optimize impact of music you pitch at NARIP’s Synch Agent Session, we highly recommend that you target the briefs.
In addition to pitching for current placement opportunities, NARIP’s guest Synch Agents will consider music pitched for representation.
Good luck and see you there!
BEFORE NARIP’S SYNCH AGENT PITCH SESSION:
OVER 1,000 PLACEMENTS FROM NARIP MUSIC SUPERVISOR SESSIONS
Our small format works! NARIP Session participants have placed over 1,000 tracks as a direct result of NARIP Music Supervisor Sessions. Other benefits include new publishing deals for NARIP members, creative collaborations and co-writes, strategic introductions to other music supervisors and placement experts, new representation for composers and much more.

OVER 1,000 PLACEMENTS FROM NARIP MUSIC SUPERVISOR SESSIONS
Our small format works! NARIP Session participants have placed well over 1,000 tracks as a direct result of NARIP Music Supervisor Sessions. Other benefits include new publishing deals for NARIP members, creative collaborations and co-writes, strategic introductions to other music supervisors and placement experts, new representation for composers and much more.
NARIP’S BIGGEST PLACEMENT TO DATE : VODAFONE
Click here to read about NARIP’s biggest placement to date in a Vodafone campaign (Oct 2014) that paid handsomely and launched a career. Other brand placements include McDonalds and AT&T ads, among others.
Placements secured and professional relationships formed through NARIPs music supervisor sessions have earned praise and many placements! See TESTIMONIALS and PLACEMENTS sections below.

SOLD OUT: NARIP Advertising Music Supervisor Pitch Session (Chase, Covergirl, Under Armour): Mike Ladman

NARIP Advertising Music Supervisor Pitch Session
with Droga5’s Mike Ladman

Co-writing Songs: Legal & Creative Issues
How To Avoid Songwriter Disputes With Dean Serwin, Esq.
What happens when two or more people co-write a song? Failure to communicate clearly or agree on splits can result in disputes that are time-consuming, expensive and unnecessary. Worse, an encumbered copyright cannot be exploited.
Organization and rights designation are vital to exploit and monetize copyrights, especially in light of recent changes and the adoption of the Music Modernization Act, the biggest copyright overhaul in years. Some of the most common disputes include three versions of the same question about ownership: who, what and how much:
1. Who is the author(s) and therefore an owner?
2. What did you contribute? Did you make a copyrightable contribution or were you just in the room? Did you merely suggest a tweak to what was already there (arrangement vs. songwriting)?
3. Splits: Is everyone equal or did some make a lesser or greater contribution? The answer to #2 can influence this.
